A Town Board meeting of the Town of Marion, Wayne County, NY was held on
Monday, September 28, 2026 at the Marion Town Court Room.
Deputy Supervisor, Julie Herman called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Public Hearing: Local Law #4-2026 ‘A Prohibition of Private Burials in the Town of Marion’
The public hearing opened at 6:31pm. The Supervisor asked three times if anyone in the room had questions or concerns and with no one coming forward, the public hearing was closed at 6:32pm.
Acknowledgements: Supervisor Cramer attended the ribbon cutting for the new Girls Softball Field at the Marion Town Board. Supervisor Cramer stated about 50 people attended. Councilwoman Taber stated it was a great event.
Councilman Lonneville stated the Marion Historic Association opened Jennis’s House (Marion Museum) on Saturday, September 26th for the Class reunion of both 1965 & 1976. Those in attendance enjoyed the musuem.

The following resolution was approved.
BE IT RESOLVED, that the Marion Town Board held a public hearing on Monday, September 28th, 2026 to create a new local law #4-2026 ‘A Prohibition of Private Burials in the Town of Marion; and
BE IT RESOLVED, that the new local law is as follows:
“A prohibition of Private Property Burial in the Town of Marion”
A Local Law prohibition the burial of human remains or the establishment of burial grounds on privately owned property in the Town of Marion.
Section 1 Title
This Local Law shall be referred to as “A Prohibition of Private Property Burial in the Town of Marion”.
Section 2 Purpose and Intent
Pursuant to the statutory powers vested in the Town of Marion (hereinafter the “Town”) to regulate and control land use, and to protect the health, safety and welfare of its residents, the Town Board of Marion (hereinafter the “Board” hereby declares a local law prohibiting the burial of human remains or the establishment of burial grounds on privately owned property within the Town.
Whereas, the Town has received inquiries regarding a property owner’s rights to bury human remains or to establish burial grounds on their private property. The Town anticipates that if will continue to receive inquiries in the future, and the Board desires to address this issue on a comprehensive Town-wide basis, rather than an ad hoc basis, and to adopt this Local Law to properly regulate same.
Section 3 Prohibitions
No person shall cause the remains of a human being, including cremated remains, to be buried, or shall establish burial grounds for such purpose in the Town in any privately-owned grounds not set apart and recognized as a municipal, religious, or not-for-profit corporation cemetery.
Section 4 Preexisting Cemeteries
This Local Law shall not alter the status on private burial grounds or cemeteries currently existing within the Town at the enactment of the Local Law.
Section 5 Enforcement.
This Local Law shall be enforceable by the Town Codes Office or any other person appointed by the Marion Town Board to enforce this local law.
Section 6 Penalties
A violation of this Local Law shall be deemed an offense and punishable, by a fine fixed by the court, not less than $500.00 nor more than $2,500.00
Section 7 Violation
The Town of Marion may seek a court order from the Supreme Court, County of Wayne to have any human remains buried in violation of this Local Law exhumed and buried in a property designated cemetery. Any person who violates this Local Law shall be liable to the Town of Marion for all legal costs to bring this court action as well as all costs to exhume the remains and bury them in property designate cemetery in the Town. In the event the person who violates this Local Law fails to pay any monies due to the violation with due demand has been made, may add these courts to the party’s Town and County tax bill.
Section 8 Validity
The invalidity of any provision of this Local Law shall not affect the validity of any other provision of this Local Law which can be given effect without such provision.
Section 9 Repealer
This Local Law shall supersede all prior local laws, ordinances, rules and regulations relative to the burial of human remains or establishment of burial grounds on private property within the Town of Marion and they shall be, upon the effectiveness of this Local Law, null and void.
Section 10 Effective Date
This Local Law shall take effect immediately upon filing in the Office of the Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.

BE IT RESOLVED, the start day will be Tuesday, September 29, 2026; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to David DeRoo, Steven Taber Highway Superintendent and the Principal Account Clerk.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Admar, Steven Taber Highway Superintendent, and the Principal Account Clerk.

The Town Board discussed the 2027 budget from 6:30pm – 8pm with the following changes made to the tentative budget. All changes were made with a motion/second and long roll vote of the Town Board members. These changes will go into the Preliminary budget.

On a Motion from Councilwoman Herman and second by Councilwoman Johnson, A decision was made to increase fund balance transfer for both Highway and General Fund. The long roll vote was as follows: Supervisor Cramer – aye, Councilwoman Herman – aye, Councilwoman Johnson – aye, Councilman Lonneville – aye, Councilwoman Taber – aye. The motion was passed 5 ayes to 0 nays.

Executive Session: On a motion from Councilwoman Herman and seconded by Councilwoman Johnson, the Town Board entered into executive session at 8:06pm to discuss an employment history of a particular person. The Executive Session closed at 8:23pm on a motion from Councilwoman Herman and seconded by Councilman Lonneville.
With no further business, on a motion by Councilwoman Johnson and seconded by Councilwoman Herman, Supervisor Cramer closed the meeting at 8:24pm.
