A Town Board meeting of the Town of Marion, Wayne County, NY was held on

Monday, September 14, 2026 at the Marion Town Court Room.

 

Deputy Supervisor, Julie Herman called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Public Hearing:                    6:30pm - FEMA Flood Plan.    The Public hearing was opened at 6:32pm with the Clerk of the Board reading the legal notice.  After the notice was read, the Deputy Supervisor asked if anyone had comments and/or questions.  After asking three times with no one commenting, the hearing was closed at 6:33pm on a motion from Councilman Lonneville and seconded by Councilwoman Johnson.

Resolution #9032026 Local Law #3 Authorize Amend Local Law #1-1988 Flood Damage Prevention

BE IT RESOLVED, that the Marion Town Board held a public hearing on Monday, September 14th at 6:30pm to amend Local Law #1-1988; and

BE IT RESOLVED, that the New York State Department of Environmental Conservation on the direction of Federal Emergency Management Agency (FEMA) and the Wayne County Planning Board have reviewed and approved the amended FEMA Flood Damage Prevention plan; and

BE IT RESOLVED, that the Marion Town Board Authorize Amending Local Law #1-1988 for Flood Damage Prevention; and

BE IT FURTHER RESOLVED The Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 

Resolution #9042026 Authorization to apply for the 2027 JCAP grant through the New York Unified Court System

BE IT RESOLVED, The Board of the Town of Marion authorizes the Marion Town Court to apply for a JCAP grant in the 2026-27 grant cycle up to $30,000.


WHEREAS, that the Marion Town Board authorizes the Supervisor and Court Justic to sign all necessary documents regarding said grant; and


WHEREAS, that the Marion Town Board directs the Clerk of the Board to give a certified copy of this resolution to the Justice Court Clerk and the principal account clerk

 

 

Resolution #9052026 Amend Resolution #6082024 Establishment of Parks & Recreation Advisory Board To Clarify Term of Board Members

The following resolution was approved.

BE IT RESOLVED, that the Marion Town Board accepts the creation and establishment a Parks & Recreation Advisory Board which shall act in accordance with and subject to the provisions, duties, and limitations of this Resolution as follows,

The governing Advisory Board shall be known as the "Parks & Recreation Advisory Board of the Town of Marion" hereinafter referred to as the "Board."

A.  The Board shall consist of a minimum of 5 but not more than 9 people who shall be residents of the Town of Marion.  They shall be appointed by the Town Board for a term of five years. All vacancies which may occur shall be filled by the Marion Town Board.

B.  A member's term expires upon the expiration of five years on the Board or when such person no longer is a resident of the Town of Marion.

BE IT RESOLVED, that the following guidelines are set forth for the Parks & Recreation Advisory Board:

(1) The Recreation Advisory Board serves at the pleasure of the Town Board in an advisory capacity. The Board shall have authority to create, direct, or dissolve the Parks & Recreation Advisory Board as needed.

(2) The Town Board makes the final determination of which persons sit on the Parks & Recreation Advisory Board. The Advisory Board may submit names for consideration, but at no time do they have the power to appoint, fill a vacancy or replace a member without the written consent of the Town Board.

(3) All members of the Parks and Recreation Advisory Board shall serve in a volunteer capacity.

(4) All members of the Parks and Recreation Advisory Board shall be residents of Marion, NY.

(5) No member of the Parks and Recreation Advisory Board shall attempt to negotiate on behalf of the Town of Marion with any outside agency or individuals regarding any matter before the Board or the Parks and Recreation Advisory Board without prior approval from the Town Board.

(6) The Parks & Recreation Advisory Board shall determine and establish meetings as necessary in order to make recommendations to the Town Board.

(7) The Parks & Recreation Advisory Board shall report to the Town Board.

(8) The Parks & Recreation Advisory Board is an advisory body to the Town Board in the matter of parks & recreation facilities, activities, staff structure, and any other topic related to parks & recreation in Marion as tasked by the Town Board.

(9) As an Advisory Board appointed by the Town Board, the Recreation Advisory Board is considered part of the Town of Marion official body. As such, all meetings of the Parks & Recreation Advisory Board are subject to Open Meeting laws, and therefore are open to the public at all times.

The Town Board of the Town of Marion expressly reserves to itself all powers not specifically granted to the Advisory Board.  Such powers include but are not limited to the following:

A. The power to make adjustments to and approve the budget of the recreation and parks department.

B. The power to lease, purchase or otherwise acquire additional real property for use as parks.

C. The power to approve rules and regulations for the operation and conduct of recreational facilities and programs.

D. The power to appoint Board Members taking into consideration the recommendation of the Advisory Board.

E. The power to employ a Director and to assign employees to the Director. The Town Board may assign employees of the Parks & Recreation Department to other Departments as may be deemed necessary.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 

Resolution #9062026 Authorize Budget Amendment to Purchase Additional CEO Williamson Law Book License

 

On a motion by Councilwoman Johnson and seconded by Councilwoman Taber

BE IT RESOLVED, the Marion Town Board authorizes a budget amendment to purchase an additional Williamson Law Book License for the Code Enforcement Office of $895 from account number 80101.01.0.100 to account number 80102.01.0.029; and

 

BE IT RESOLVED, that the

 

AND BE IT FURTHER RESOLVED, that the Marion Town Board of the Town of Marion authorizes the Clerk to the Board to give a copy of this resolution to Williamson Law Book and the Principal Account Clerk.

 

Resolution #9072026 Authorize Supervisor to Sign Additional Software License Agreement for Buildings & Code Enforcement with Williamson Law Book

 

On a motion by Councilman Lonneville and seconded by Councilwoman Taber

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the new additional Software License Agreement for Building & Codes Enforcement with Williamson Law Book Company; and

 

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Additional Software Support Contract for 2026 with Williamson Law Book as attached at an annual cost of $895 to be appropriated from account #80102.01.0.029; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk, Code Enforcement Officer and Williamson Law Book Company.

 

Resolution #9082026 Authorize Hiring Preston’s Tree & Landscape for Tree Removal at the Marion Cemetery

 

On a motion by Councilman Lonneville and seconded by Councilwoman Johnson

The following resolution was approved.

 

WHEREAS, the Marion Town Board sent out a Request for Proposal to have 3 trees removed from the Marion Cemetery; and

 

BE IT RESOLVED, the Town of Marion received 3 proposals; and

 

BE IT RESOLVED, that the Marion Town Board authorizes the hiring of Preston’s Tree & Landscape for the amount not to exceed $4, 500 to be taken from account # 88104.01.0.142

 

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk

 

Resolution #9072026 Authorization Deposit of Funds Received for Town Park Bathroom Damage Restitution.

WHEREAS, the Town of Marion authorizes the Principal Account Clerk to deposit funds of $310 received for the Town Park bathroom damages restitution into the Park Reserve Fund account # 230.01; and

 

BE IT FURTHER RESOLVED, that the Town Board authorizes the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

 

 

 

Resolution #9102026 Authorize Hiring MEO Full Time Employee at the Marion

WHEREAS, Steven Taber, Highway Superintendent for the Town of Marion has recommended hiring a MEO full time employee; now

 

BE IT RESOLVED that the Marion Town Board accepts said recommendations and authorizes hiring Jacob Marr, of Cambier Rd. Marion, NY effective September 15, 2026, at remuneration of $29.32 per hour for 2026 from account # 51101.03.0.118; and

 

BE IT RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Jacob Marr, Highway Superintendent, and the Principal Account Clerk.

 

Resolution #9112026 Authorize Scheduling a Public Hearing to Establish Local Law #4 “A Prohibition of Private Burials in the Town of Marion.

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion that a Public Hearing will be held on Monday, September 28, 2026 @ 6:30pm in the Marion Court Room for the purpose of establishing Local Law #4 “A Prohibition of Private Burials in the Town of Marion”; and

 

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #9132026 Marion Fall Festival Parking Lot Closure

The following resolution was approved.

 

BE IT RESOLVED, that the Marion Town Board hereby requests the following Municipal parking lot next to Jennies House and next to Marion Elementary School to be fully closed to all traffic on Friday, October 2, 2026 starting at 4pm through Saturday October 3, 2026 from 7 a.m. – 6p.m; and 

 BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to local businesses and Town employees.

BE IT FURTHUR RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Marion Historic Association, Marion Events Organization and Principal Account Clerk, Kathy Cauwels.

 

Resolution #9142026 Marion Fall Festival Road Closure

 

On a motion by Councilwoman Johnson and seconded by Councilwoman Taber

The following resolution was approved.

 

BE IT RESOLVED, that the Marion Town Board hereby requests the following streets to be fully closed to all traffic on Saturday October 3, 2026 from 7 a.m. – 6 p.m.

 

North Main Street from the South side of the Elementary School driveway to Buffalo Street

South Main Street from Buffalo Street to Mill Street

Maple Ave from Main Street to the Marion Public Library.

 

BE IT RESOLVED, that the Marion Town Board hereby request the following streets to be closed but open to local and festival traffic only on Saturday October 3, 2026 from 7 a.m. – 6 p.m.

 

Buffalo Street to Route 21

Maple Ave at Union Street

North Main Street from Sunset Drive to Union Street

 

BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to E911, Marion Fire Department, Western Wayne Ambulance, Marion Fire District, Nutall Golf Cart and Storage, Marion Post Office, Wayne County Highway Department, Wayne County Sheriff, NYS Police Substation, Williamson, WCWSA, Marion School District Bus Garage, Marion Highway Department, and Marion Library.

 

Resolution #9152026 Authorize the Marion Historic Association to hold an event in the Marion Cemetery.

 

On a motion by Councilman Lonneville and seconded by Councilwoman Taber

The following resolution was approved.

 

BE IT RESOLVED, that the Marion Town Board authorizes the Marion Historic Association to use the Marion Cemetery located between North Main Street and Buffalo Street for their event titled ‘Haunting in the Hamlet’; and

 

BE IT RESOLVED, that this event will take place on October 10th, 2026 and the entrances to the cemeteries will be closed to vehicle traffic from 5:30pm  - 9pm; and

 

BE IT RESOLVED, that the Marion Historic Association will provide the Town of Marion a certificate of insurance for this event; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Marion Historic Association and the Principal Account Clerk.

 

Additional Resident Comments: 2 people spoke during this time.

 

Executive Session:  On a motion from Councilman Lonneville and seconded by Councilwoman Johnson, the Town Board entered into executive session at 7:17pm to discuss an employment history of a particular person. The Executive Session closed at 7:20pm on a motion from Councilman Lonneville and seconded by Councilwoman Johnson.

 

With no further business, on a motion by Councilwoman Johnson and seconded by Councilwoman Taber, Deputy Supervisor Herman closed the meeting at 7:20pm.
