TOWN BOARD MEETING MINUTES

A Town Board meeting of the Town of Marion, Wayne County, NY was held on

Monday, June 22, 2026 at the Marion Town Court Room.

 

Supervisor, Mike Cramer called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Public Hearing:     Local Law #2-2026 “Real Property Tax Levy Limit”

The Public hearing opened at 6:33pm with the Clerk of the Board reading the legal notice.  Supervisor Cramer then asked if anyone in the room had questions or concerns.  One person asked questions and these were answered.  After asking three times, the public hearing was closed on a motion from Councilwoman Herman and seconded by Councilman Lonneville and ayed by all Town Board members at 6:35pm.

 

Acknowledgements:     Supervisor Cramer acknowledged the Marion Fire Department, EMS services and the Marion Highway Department for their work during the wind storm on June 18th.

Resident Comments:  Two people spoke during this time.  Both expressed concern about possible chicken regulations.

Resolution #612-2026 Adopt Local Law #2-2026 Entitled “Real Property Tax Levy Limit”

 

On a motion by Councilman Lonneville and seconded by Councilwoman Herman

The following resolution was approved.

 

BE IT RESOLVED, that the Marion Town Board Adopts Local Law #2-2026 “Real Property Tax Levy Limit”:

 

Section 1.  Legislative Intent

It is the intent of this Local Law to override the limit on the amount of real property taxes that may be levied by the Town of Marion pursuant to General Municipal Law §3-c, and to allow the Town of Marion to adopt a budget for the fiscal year 2027 that requires a real property tax levy more than the "tax levy limit" as defined by General Municipal Law §3-c.

 

Section 2. Authority

This Local Law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by the vote of sixty percent (60%) of the town board.

 

Section 3. Tax Levy Limit Override

The Town Board of the Town of Marion, County of Wayne, is hereby authorized to adopt a budget for the fiscal year 2026 that requires a real property levy more than the amount otherwise proscribed in General Municipal Law, §3-c.

 

Section 4. Severability

If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person,  individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.

 

Section 5. Effective Date. This Local Law shall take effect immediately upon filing with the Secretary of State.

 

Resolution #613-2026 Authorize Speed Limit Survey for Marion-Walworth Rd.

 

On a motion by Councilwoman Herman and seconded by Councilwoman Taber

 

ADOPTED:  Ayes: 5   Herman, Johnson, Lonneville, Taber, Cramer

     

                     Nays: 0

 

The following resolution was approved.

 

WHEREAS, the Marion Town Board has received a request for a speed limit survey on Marion Walworth Road from resident, Rachel Bentley; now

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to petition the Wayne County Highway Department and the New York State Department of Transportation to conduct a speed limit survey of Marion Walworth Road between Cory Hill Road and Cory Corners/Parker Road intersection; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to Rachel Bentley, Wayne County Highway Department, NYS Department of Transportation and Marion Highway Department.

 

Resolution #614-2026 Rescind Resolution #611-2026 Authorize Hiring Part-time Code Enforcement Officer

 

On a motion by Councilman Lonneville and seconded by Councilwoman Herman

 

ADOPTED:  Ayes: 5   Herman, Johnson, Lonneville, Taber, Cramer

     

                     Nays: 0

 

The following resolution was approved.

 

WHEREAS, the Marion Town Board authorizes the hiring of Charles Fox of Harris Rd. Penfield, NY, as part-time Code Enforcement Officer for the Town of Marion with employment starting on June 9, 2026; and

 

BE IT RESOLVED, the Town Board authorizes the following accounts to be used for payroll, 80101.01.0.100 at a rate of $29 per hour for no more than 20 hours per week and;

 

 

BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Charles Fox.

 

Resolution #615-2026 Authorize Advertising for a Part time Code Enforcement Officer

On a motion by Councilwoman Herman and seconded by Councilman Lonneville

 

ADOPTED:  Ayes: 5   Herman, Johnson, Lonneville, Taber, Cramer

     

                     Nays: 0

 

The following resolution was approved.

 

 

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise for the position of part time Code Enforcement Officer with certifications at a rate of pay of $29 per hour in the legal newspaper for the Town of Marion; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Principal Account Clerk.

 

Resolution #616-2026 Authorization to Accept the Hiring of 6 Summer Recreation Counselors and 1 Fill-In Counselor

On a motion by Councilwoman Johnson and seconded by Councilwoman Taber

 

ADOPTED:  Ayes: 5   Herman, Johnson, Lonneville, Taber, Cramer

     

                     Nays: 0

BE IT RESOLVED, that the Marion Town Board authorizes the following individuals for 2026 for the Summer Recreation Camp Program Counselor Position for $16/hour to be appropriated from account 73101.01.000.080,

Isabella Keyser- Counselor

Hayley Wurster- Counselor

Leah Colburn- Counselor

Ngalula Mulowayi - Counselor

Taylor Mattison - Counselor

Neely Crocker as a fill-in/floater for vacation days or missed days; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all of the individuals listed above and the Principal Account Clerk.

 

Resolution #617-2026 Authorization to Accept the Hiring of 1 Summer Recreation Head Counselor

On a motion by Councilwoman Herman and seconded by Councilwoman Taber

BE IT RESOLVED, that the Marion Town Board authorizes the following individuals for 2026 for the Summer Recreation Camp Program Counselor Position for $18.50/hour to be appropriated from account 73101.01.000.081,

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Grace Colburn listed above and the Principal Account Clerk.

Resolution # 618-2026 Award Contract to Complete Drainage Work on Dean Road

 

On a motion by Councilman Lonneville and seconded by Councilwoman Taber

                     Nays: 0

 

The following resolution was approved.

 

WHEREAS, the drainage work needs to be done on Dean Roads; and

 

BE IT RESOLVED, that the Marion Town Board awards the contract to Decker Excavating, which is the county contractor,  to complete drainage work on Dean Road; and

 

BE IT FURTHER RESOLVED, that the Marion Town Board awards the bid to Decker Excavating with an amount not to exceed $4,000 to be expensed as follows:

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Drainage Committee, Decker Excavating and the Principal Account Clerk.

 

Resolution #619-2026 Approve Refund of Park Rental Due to Poor Conditions

 

On a motion by Councilwoman Herman and seconded by Councilwoman Taber

                     Nays: 0

 

The following resolution was approved.

 

 

WHEREAS, the Cathy Cowell reserved the indoor pavilion at the Town Park; and

 

BE IT RESOLVED, that the Marion Town Board approves the refund of $125; and

 

BE IT FURTHER RESOLVED, the Clerk of the Board to give a copy of this resolution to Cathy Cowell and the Principal Account Clerk.

 

Resolution #620-2026 Authorize Advertising for a Part time Maintenance Employee

On a motion by Councilwoman Herman and seconded by Councilwoman Johnson

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise for the position of part time maintenance employee at a rate of pay of $20 per hour in the legal newspaper for the Town of Marion; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Principal Account Clerk.

 

Resolution #621-2026 Accept Resignation of Full Time Employment of Deputy Town Clerk

 

On a motion by Councilwoman Herman and seconded by Councilwoman Taber

BE IT RESOLVED, that the Marion Town Board accepts the resignation of the Full-Time employment of Deputy Town Clerk, Caylin Stappenbeck effective Friday, July 3, 2026; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Principal Account Clerk.

 

Resolution #622-2026 Authorize Advertising for a Full-Time Deputy Town Clerk

On a motion by Councilwoman Herman and seconded by Councilwoman Taber

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise for the position of full time Deputy Town Clerk at a rate of pay of $19 per hour in the legal newspaper for the Town of Marion; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Principal Account Clerk.

 

Resolution #623-2026  Authorize Trust Account Transfer to Money Market

 

On a motion by Councilman Lonneville and seconded by Councilwoman Herman

The following resolution was approved.

 

BE IT RESOLVED, that the Marion Town Board approves the Transfer of the following Trust Account #37.99 in the amount of $75 to the Money Market Park Rental Donation Account # 2030.01 due to unpaid park rental fee; and

 

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

           

Resolution #624-2026  Payment of Claims

 

On a motion by Councilman Lonneville and seconded by Councilwoman Herman

WHEREAS, the Marion Town Board has received and audited the following claims; now

 

BE IT RESOLVED, that the Supervisor is hereby authorized to pay said claims upon receipt of the signed abstracts of audited claims from the Town Clerk.

Executive Session: The Town Board went into executive session at 7:18pm to discuss matters relating to employment history of a particular person. The Executive Session closed at 7:32pm on a motion from Councilwoman Herman and seconded by Councilwoman Taber.

 

With no further business, on a motion by Councilwoman Herman and seconded by Councilwoman Johnson, Supervisor Cramer closed the meeting at 7:33pm.
