TOWN BOARD Meeting Minutes

Marion Court Room

Monday, January 22, 2024

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, January 22, 2024 at the Marion Court Room.

Supervisor Johnson called the meeting to order at 6:30pm and asked the Clerk of the Board to give a roll call.

Supervisor Johnson asked everyone to stand and give the Pledge of Allegiance.

Visitors:

Rob Richardson – Clean Energy

Mr. Rob Richardson Clean Energy Communities Coordinator for Genesee/Finger Lakes Regional Planning Council spoke to the Town Board for one hour and 15 minutes on different projects and programs available to the Town of Marion that would qualify the Town for grants. The Town of Marion has been a part of this program since 2017 and has already received a $5,000 grant. The Town Board enjoyed the presentation and asked many questions. The Marion Town Board thanked Councilman Lonneville for getting started on this program many years ago as well as Mr. Richardson for taking time out of his schedule to meet with the Town Board.

Cemetery

Town Clerk Heidi Levan spoke regarding the Marion Cemetery. Ms. Levan and Highway Superintedent, Tim Boerman have met and came up with a list of job responsibilities for both the Town Clerk’s office and Highway Department regarding the cemetery. Each Town Board member received a copy of this electronically in their email as well as a hard copy in this evening’s packet. Councilwoman Herman thanked by Mr. Boerman and Ms. Levan for their time and effort on this new process. Councilwoman Herman also stated Sarah from the NYS Cemetery Division will be meeting with Councilwoman Herman this week regarding the final audit of the cemetery books. Councilwoman Herman will report back to the Town Board after the meeting takes place.

Town Projects

Councilman Lonneville gave an update on Town of Marion projects. The doorknob on the Judges office has been switched from a locking doorknob to a non-locking doorknob which allows for emergency exit from the Court Room. New Exit signs have been ordered for this area of the Court Room.

Councilman Lonneville next stated the new Dusk to Dawn LED lighting at the Town Park has been completed and Councilman Lonneville has received great feedback from residents who are appreciative of these new lights. The inside of the Main Pavilion is still being worked on and hope to have the upgrades complete by April 1, 2024.

Seneca Foods

Councilman Lonneville gave an overview of Seneca Foods. The old Seneca Foods is owned by Brad Persons. Mr. Persons rents the facility to a variety of businesses for storage. This has been great business for Mr. Persons and the town sees a lot of trucks going and coming from the facility.

Lollipops & Polka Dots

Councilman Lonneville stated he stopped into the new Lollipops & Polkadots location. This location is much bigger than the original spot.

Drainage

Councilman Lonneville asked if a 2024 Drainage committee meeting has been scheduled. Councilwoman Herman stated it has not but she has been working with Councilman Cramer to get up to speed on this new committee assignment.

Sewer Spill Update

Supervisor Johnson stated she has been working with Jeff Cragg regarding the fuel oil spill that took place on Union Street that ended up in the Marion Sewer lines. Mr. Cragg also commented stating all sampling of the sewer lines have been done and submitted for testing. Mr. Cragg also stated a NYS DEC officer has been to the Marion Sewer plant (Wastewater Treatment Plant) and has received the letter that was written by Mr. Cragg and Supervisor Johnson. Councilman Lonneville thanked Mr. Cragg and Mr. Steve Taber for this quick response to this problem. Councilman Lonneville also suggested that a letter be written to the Marion Fire Department.

Solar Eclipse Committee – Looking for community volunteers who are not Town Board members.

Supervisor Johnson stated the Marion Solar Eclipse committee met and this event has been turned over to the Marion Events Committee. A decision was made to close the library from 12:30pm to 5pm. The Schools will also be closed this day. Another decision was made to only have community and county venders at this event – no commercial vendors will be allowed to have a booth. The next meeting will take place on February 15th.

Discussion:

  • Councilwoman Herman stated that two applications have been received for the Marion Historian position. Councilwoman Herman will be setting up interviews for both candidates in the near future.
  • Councilman Lonneville stated that 2nd Deputy Town Clerk, Nadine Seppeler is currently working on updating the business listing for the Town of Marion. Once the updates are complete the list will be added to the Town’s website.
  • Supervisor Johnson asked that a copy of the latest edition of Robert’s Rules of Order (12th addition) be purchased and be available at the Town Hall for Town Board members to review if necessary. Town Clerk Heidi Levan will take care of this purchase.

Citizens Comments:

Heidi Levan spoke as a resident and not as the Town Clerk. Ms. Levan brought her concerns for the sidewalks in Marion. This is the 7th year in a row that Ms. Levan has stated the problem with sidewalks in town not being cleared of snow. This makes for dangerous conditions for residents walking. Ms. Levan walks daily and has been forced to walk in the streets because the sidewalks are not cleared of snow. The Town Board thanked Ms. Levan for her concerns.

If you are attending a Town Board Meeting and have not signed up for the Public Participation Section of the Town Board Meeting (24 hours prior to start of meeting), then you will not be able to express your opinion. As a courtesy to those who attend the Board Meeting, you are requested not to interrupt the meeting, and refrain from conversation that would interfere with those attending being able to hear the Board transact its business. If in fact someone interferes with the meeting or the conversation with other spectators should require a warning and it is ignored, the person could be charged with Disorderly Conduct. For public hearings, speaking will be limited to topics on the agenda.

BE IT RESOLVED, according to our employee handbook, this position is required to punch a time clock which is in the office at the lodge; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Gina Marie Abate-Shumski and the Principal Account Clerk.

WHEREAS, monthly charges automatically utilize this credit card; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Lyons National Bank, Heidi Levan and the Principal Account Clerk.

Resolution #123-24 Marion Cemetery Association conveyance to the Town of Marion

The following resolution was adopted

WHEREAS, the Marion Town Board received a letter from the Marion Cemetery Association on August 14, 2024 stating the Marion Cemetery Association would like to convey the Marion Cemetery located on Cemetery Drive to the Town of Marion effective January 1, 2024; now

BE IT RESOLVED, that the Marion Town Board accepts this conveyance effective January 1, 2024.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Marion Cemetery Association and the Principal Account Clerk.

Citizens Comments:

None

The Town Board went into executive session to discuss the employment history of a particular person on a motion by Councilman Cramer and seconded by Councilwoman Herman at 8:26pm.

With no further business, on a motion by Councilman Cramer and seconded by Councilwoman Herman, Supervisor Johnson closed the meeting at 9:10pm.
