BE IT RESOLVED, that the Marion Town Board accepts the May 11th & 26th, 2026 Town Board meeting minutes.
Resolution # 2 Voluntary Shelter Donation on Dog License Renewals

WHEREAS, Chapter 59 of the Laws of 2010 as amended where further amended, effective December 2025, to require a line item on dog license renewals giving applicants the option of making a contribution in support of the pound or shelter managed or contracted by the municipality and deposit said funds in a dedicated fund to disperse annually to the applicable pound or shelter; and
WHEREAS, the Town of Marion contracts for these services with the Humane Society of Wayne County (HSWC); and
WHEREAS, the Marion Town Clerk’s Office has initiated this requirement by listing the option to make donations to the HSWC on all dog licensing renewal processes and establishing the an accounting line be added to the monthly reconciliation and payment to the Town Supervisor for monies taken in by the Town Clerk’s Office; and
BE IT RESOLVED, that the Marion Town Board acknowledges the new legislation and approves the establishment of this process and procedure; and
BE IT FURTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #3 Authorize Scheduling a Public Hearing to Amend Local Law #1-1988 Flood Damage Prevention

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion that a Public Hearing will be held on Monday June 22, 2026 @ 6:30 P.M. at the Marion Court Room for the purpose of Amending Local Law #1-1988 for Flood Damage Prevention; and
BE IT FURTHER RESOLVED The Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #4 Authorize Public Hearing for a Local Law Entitled “Real Property Tax Levy Limit”

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise in the legal newspaper for the Town of Marion as follows:
The Marion Town Board will hold a Public Hearing on Monday, June 22, 2026, at the Marion Court Room, 3827 North Main Street, Marion, for a proposed Local Law #2 - 2026 regarding the “Real Property Tax Levy Limit” as follows:
Local Law #2 - 2026 “Real Property Tax Levy Limit”
Section 1. Legislative Intent
It is the intent of this Local Law to override the limit on the amount of real property taxes that may be levied by the Town of Marion pursuant to General Municipal Law §3-c, and to allow the Town of Marion to adopt a budget for the fiscal year 2027 that requires a real property tax levy more than the "tax levy limit" as defined by General Municipal Law §3-c.
Section 2. Authority
This Local Law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by the vote of sixty percent (60%) of the town board.
Section 3. Tax Levy Limit Override
The Town Board of the Town of Marion, County of Wayne, is hereby authorized to adopt a budget for the fiscal year 2027 that requires a real property levy more than the amount otherwise proscribed in General Municipal Law, §3-c.
Section 4. Severability
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5. Effective Date. This Local Law shall take effect immediately upon filing with the Secretary of State.
Resolution #5 Authorize Hiring Roger Ortiz-Olivera for 2026 Seasonal Lawn Care/Maintenance at the Marion Cemetery

BE IT RESOLVED, that the Marion Town Board authorizes Roger Ortiz-Olivera for 2026 seasonal Lawn Care/Maintenance for the Marion Cemetery remuneration of $16/hour to be appropriated from account 88101.01.000.255; and
BE IT RESOLVED, the start day will be Tuesday June 9th, through October 1st ; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Roger Ortiz-Olivera and the Principal Account Clerk.
Resolution #6 Authorization to Require Exact Amount for Cash Tax Payment

WHEREAS, the last penny was minted on November 12, 2025, at the United States Mint in Philadelphia, Pennsylvania; and
WHEREAS, banks are no longer able to purchase any additional pennies; and
WHEREAS, tax bills must be paid with exact to the penny and the Marion Tax Collector may not be able to make change; and
BE IT RESOLVED, that cash tax payments are now required to be made for the exact amount of the tax bill; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #7 Accept Resignation of Maintenance Staff member, Nick Lucci

BE IT RESOLVED, that the Marion Town Board regretfully accepts the resignation of Nick Lucci from the Town of Marion Maintenance position; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
Resolution #8 Authorize the advertising for 10 volunteer Comprehensive Plan Committee members

WHEREAS, the Marion Town Board desires to keep an up-to-date growth plan for the Town of Marion; now
BE IT RESOLVED, that the Marion Town Board authorizes advertising for 10 new committee members to the Marion Comprehensive Plan Committee to prepare a Comprehensive Plan; and
BE IT RESOLVED, that the Marion Comprehensive Plan Committee members are to be comprised a diverse group of people both in backgrounds and professions of 10 people; and
BE IT RESOLVED, that the Marion Comprehensive Plan Committee shall meet monthly and provide monthly reports to the Marion Town Board and;
BE IT RESOLVED, that each member is a volunteer; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Principal Account Clerk, Supervisor and Planning and Zoning Board members.
Resolution #9 Authorize Volunteer Facilities Document

BE IT RESOLVED, that the Marion Town Board has reviewed on the recommendation from the Town’s Insurance company, a Facilities Document to be used for anyone who volunteers on the Town of Marion property; and
BE IT RESOLVED, that the Marion Town Board requires a signed agreement for all volunteers; and
BE IT FUTHER RESOLVED, that a copy of the Facilities Document is available for review at the Marion Town Clerk’s Office; and
BE IT FUTHER RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.
