Resolution #1 Adopt Local Law #2-2026 Entitled “Real Property Tax Levy Limit”

BE IT RESOLVED, that the Marion Town Board Adopts Local Law #2-2026 “Real Property Tax Levy Limit”:
Section 1. Legislative Intent
It is the intent of this Local Law to override the limit on the amount of real property taxes that may be levied by the Town of Marion pursuant to General Municipal Law §3-c, and to allow the Town of Marion to adopt a budget for the fiscal year 2027 that requires a real property tax levy more than the "tax levy limit" as defined by General Municipal Law §3-c.
Section 2. Authority
This Local Law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the town board to override the tax levy limit by the adoption of a local law approved by the vote of sixty percent (60%) of the town board.
Section 3. Tax Levy Limit Override
The Town Board of the Town of Marion, County of Wayne, is hereby authorized to adopt a budget for the fiscal year 2026 that requires a real property levy more than the amount otherwise proscribed in General Municipal Law, §3-c.
Section 4. Severability
If any clause, sentence, paragraph, subdivision, or part of this Local Law or the application thereof to any person firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this Local Law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5. Effective Date. This Local Law shall take effect immediately upon filing with the Secretary of State.
Resolution #2 Authorize Speed Limit Survey for Marion-Walworth Rd.

WHEREAS, the Marion Town Board has received a request for a speed limit survey on Marion Walworth Road from resident, Rachel Bentley; now
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to petition the Wayne County Highway Department and the New York State Department of Transportation to conduct a speed limit survey of Marion Walworth Road between Cory Hill Road and Cory Corners/Parker Road intersection; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to send a copy of this resolution to Rachel Bentley, Wayne County Highway Department, NYS Department of Transportation and Marion Highway Department.
Resolution #3 Rescind Resolution #611-2026 Authorize Hiring Part-time Code Enforcement Officer

WHEREAS, the Marion Town Board authorizes the hiring of Charles Fox of Harris Rd. Penfield, NY, as part-time Code Enforcement Officer for the Town of Marion with employment starting on June 9, 2026; and
BE IT RESOLVED, the Town Board authorizes the following accounts to be used for payroll, 80101.01.0.100 at a rate of $29 per hour for no more than 20 hours per week and;
BE IT FURTHER RESOLVED that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Charles Fox.
Resolution #4 Authorize Advertising for a Part time Code Enforcement Officer

BE IT RESOLVED, that the Marion Town Board authorizes the Clerk of the Board to advertise for the position of part time Code Enforcement Officer with certifications at a rate of pay of $29 per hour in the legal newspaper for the Town of Marion; and
BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Principal Account Clerk.
Resolution #5 Authorization to Accept the Hiring of 6 Summer Recreation Counselors and 1 Fill-In Counselor

Resolution # 7 Award Contract to Complete Drainage Work on Dean Road

WHEREAS, the drainage work needs to be done on Dean Roads; and
BE IT RESOLVED, that the Marion Town Board awards the contract to Decker Excavating, which is the county contractor, to complete drainage work on Dean Road; and
BE IT FURTHER RESOLVED, that the Marion Town Board awards the bid to Decker Excavating with an amount not to exceed $4,000 to be expensed as follows:

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Drainage Committee, Decker Excavating and the Principal Account Clerk.
Resolution #8 Approve Refund of Park Rental Due to Poor Conditions
