TOWN BOARD ORGANIZATIONAL MEETING MINUTES

Marion Court Room

Monday, January 6, 2025

A Town Board meeting of the Town of Marion, Wayne County, NY was held on Monday, January 6, 2025 at the Marion Town Court Room.

Supervisor Johnson called the meeting to order at 3pm and asked the Clerk of the Board to give a roll call.

Resolution #101-2025 Authorize Supervisor to Sign Town Clerk Annual Software Support Contract with Williamson Law Book

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Town Clerk Annual Software Support Contract for 2025 with Williamson Law Book Company for an annual cost of $1096.00 to be appropriated from account 14102.1.0.029; and

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and Williamson Law Book Company.

Resolution #102-2025 Authorize Supervisor to Sign Software License Agreement for Buildings & Code Enforcement with Williamson Law Book and Annual Software Support Contract

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Software License Agreement for Building & Codes Enforcement with Williamson Law Book Company; and

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the Annual Software Support Contract for 2025 with Williamson Law Book as attached at an annual cost of $862.00 to be appropriated from account #80102.01.0.029; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk, Code Enforcement Officer and Williamson Law Book Company.

Resolution #103-2025 Designate Legal Newspaper for The Town of Marion for 2025

On a motion by Councilman Cramer and seconded by Councilwoman Taber

The following resolution was approved.

BE IT RESOLVED, that the Marion Town Board authorizes the Times of Wayne County as the legal newspaper for the Town of Marion for the fiscal year commencing January 1, 2025; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town of Marion Department Heads and the Times.

Resolution #104-2025 Adopt 2025 Mileage Reimbursement Rate

On a motion by Councilman Cramer and seconded by Councilwoman Taber

The following resolution was approved.

WHEREAS, the Marion Town Board adopted a mileage reimbursement policy per resolution #030608; and

NOW BE IT RESOLVED, that the Marion Town Board sets the reimbursement rate @ $ .70 effective January 1, 2025; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to all Town employees and Department Heads.

Resolution #105-2025 Re-Appoint Town Attorney

BE IT RESOLVED, that David Fulvio shall be reimbursed for services performed on an as needed basis at the rate of $200.00 per hour; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Town of Marion Department Heads, and David Fulvio

Resolution #106-2025 Authorize the Town Clerk to Advertise Town Board Meetings for 2025

On a motion by Councilman Lonneville and seconded by Councilwoman Taber

The following resolution was approved.

BE IT RESOLVED, Authorize the Town Clerk to advertise in the legal newspaper for the Town of Marion as follows:

BE IT RESOLVED, The Marion Town Board meetings for 2025 will be held on the 2nd and 4th Monday of each month except for federal holidays. If a federal holiday falls on a Monday, the Marion Town Board will meet on Tuesday of that week. All meetings are held in the Marion Court Room located at 3827 N. Main Street, Marion, NY 14505 and, All meetings start at 6:30 p.m. and are open to the public.

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #107-2025 Approve Bid and Authorize Payment for Main Street Lawn Care and Maintenance

WHEREAS, the Town received one bid:

Bovet Lawn and Garden LLC for $1,865 for the defined 2025 season, to be expensed from account 85104.01.000.0.232

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Bovet Lawn and Garden LLC, and the Town Principal accountant.

Resolution #108-2025 Approve Bid and Authorize Payment for 3 Abandoned Cemeteries Lawn Care and Maintenance

WHEREAS, the Town received one bid:

Bovet Lawn and Garden LLC for $2,880 for the defined 2025 season, to be expensed from account 88104.01.000.000

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Bovet Lawn and Garden LLC, and the Town Principal accountant.

Resolution #109-2025 Authorize Supervisor to Sign the 2025 Contract with Wayne County Public Works – Snow & Ice

BE IT RESOLVED, that the Marion Town Board authorizes the Supervisor to sign the 2025 contract with Wayne County Public Works – Snow & Ice; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the County of Wayne, Marion Highway Superintendent, and the Principal Account Clerk.

Resolution #110-2025 Appoint Steve Matteson to the Wayne County EMS Advisory Board

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Steve Matteson and the Supervisor.

Resolution #111-2025 Amend Budget to Reflect the Updated New York State Minimum Wage Requirements for 2025

BE IT RESOLVED, the Marion Town Board received updated New York State minimum wage requirements; and

THEREFORE, the following budgetary items will be amended to reflect the rate of $15.50; and

Amending the budget to include the COLA at 3% in addition to the minimum wage increase; and

Account 16201.01.0.041 amended to $15.96 per hour, not to exceed three hours per week; and

Account 71101.01.041 amended to $15.96 per hour; and

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk.

Resolution #112-2025 Authorization for the Supervisor to Register and Attend the OSC Online, Accounting Principles and Procedures CLE Course

BE IT RESOLVED, that the Town Board authorizes for the Supervisor to Register and Attend the OSC Online, Accounting Principles and Procedures CLE Course; at the cost of $85.00 to be expensed out of account, 12204.01.004

BE IT RESOLVED, the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to the Principal Account Clerk and the Supervisor.

Resolution #114-2025 Authorize Re-Appointment of Mark Plyter as Dog Control Officer

BE IT RESOLVED, that the rate of pay will be $353.27 paid bi-weekly for a yearly total of $9,185 to be taken from account number 35101.01.0.000; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Mark Plyter and the Principal Account Clerk.

Resolution #115-2025 Authorize Re-Appointment of Mike Hershelman to Zoning Board

On a motion by Councilman Cramer and seconded by Councilwoman Herman

The following resolution was approved

BE IT RESOLVED, that the Marion Town Board re-appoints Mike Hershelman, 3515 Sand Hill Road, Marion NY, to the Zoning Board effective January 1, 2025 thru December 31, 2032; and

BE IT RESOLVED, that the Marion Town Board directs the Clerk of the Board to give a copy of this resolution to Mike Hershelman, Adrienne Compton and the Principal Account Clerk.

Citizen Comments:

Two residents spoke during this time.

With no further business, on a motion by Councilwoman Herman and seconded by Councilman Cramer, Supervisor Johnson closed the meeting at 7:35pm.
